Divorce
Australian law has established the principle of no-fault divorce in that the court does not consider the reason a marriage has ended. The only ground for divorce is that the marriage has broken down irretrievably and there is no reasonable likelihood that the parties will get back together.
You must have been separated for at least 12 months and one day to satisfy the Court that the marriage has broken down irretrievably. It is sometimes possible to obtain a Divorce if there has been a separation under the one roof. If you have children under the ages of 18 years old, the Court can only grant a Divorce if it is satisfied that proper arrangements have been made for their welfare.
You can either apply for a joint application for divorce or a single application but in the event you file a single application, the Application for Divorce must be served on the other party.
